License to use statistical information produced and disseminated by the National Statistical Institute

1. GENERAL INFORMATION
 
1.1. Provision of statistical information:
 
The National Statistical Institute (NSI) shall disseminate statistical information by means of:
1.1.1. Internet site: www.nsi.bg;
1.1.2. Information system „Infostat” (IS „Infostat”): https://infostat.nsi.bg/infostat;
1.1.3. Own printed and electronic publications;
1.1.4. Press releases;
1.1.5. Press conferences;
1.1.6. Media and social networks;
1.1.7. Direct relationships with users based on contracts and agreements;
1.1.8. Direct relationships with users based on standard requests and inquiries;
1.1.9. Library and reception desk at the Head Office (HO) and reception desks at regional structures of the NSI;
1.1.10. Digital library, accessible at: https://www.nsi.bg/biblioteka/.
 
In accordance with Article 3 (8) of the Law on statistics the National Statistical Institute, the statistical authorities and the Bulgarian National Bank shall be the source of official statistical information in the Republic of Bulgaria. The National Statistical Institute shall coordinate the statistical activity of the state and the statistical authorities shall work under the methodological guidance of the NSI when implementing the National Statistical Programme (NSP). 
The National Statistical Institute shall collect, process and store individual data and statistical information. The National Statistical Institute is personal data controller and is registered as such in the Register of data controllers and kept by them registers of personal data with identification № 30229. The statistical information collected, processed and stored by the NSI shall be maintained in databases.
 
1.2. Main concepts
 
1.2.1. "License" is a word of Latin origin (sino, licentia, patiorсе), meaning permission to perform an action. According to the explanatory dictionary, meaning of the word "license" includes the right to use patented invention or production. The NSI will use the concept "license" in the sense of permission to use statistical information available through any of the means listed in Section 1, item 1.1. and under the conditions specified in Section 2;
1.2.2. "Database" means a collection of independent works, data or other materials, arranged systematically or methodically and individually accessible in electronic or other way (§2, 13 of the Additional provisions of the Law on the copyright and related rights);
1.2.3. "Statistical information" is aggregate, quantitative and representative information about the status and/or dynamics of mass phenomena in existing populations of statistical units in economy, demographics, social area and environment. (§1, 3 of the Additional provisions of the Law on statistics);
1.2.4. "Individual data" are data about a specific statistical unit (§1, 2 of the Additional provisions of the Law on statistics);
1.2.5. "Personal data" shall refer to any information relating to an individual who is identified or identifiable, directly or indirectly, by reference to an identification number or to one or more specific features. (Art. 2, 1 of the Law for protection of personal data);
1.2.6. "Statistical secret" is a principle, according to which, data, relating to individual subjects, are protected, obtained directly for statistical purposes or indirectly from administrative or other sources. This entails a ban on using the data obtained for other purposes than statistical ones and a ban on their illegal disclosure. (§1, 15 of the Additional provisions of the Law on statistics);
1.2.7. "Reproduction" means multiplication of the information or any part of it in one or more copies, in any manner and in any form, permanent or temporary, including storing in digital form on electronic media;
1.2.8. "Dissemination" means all activities, in which all the information or part of it is provided, announced, displayed or presented;
1.2.9. "Use" means reproduction of the information, dissemination among unlimited number of persons, public performance, wireless broadcasting, transmission and retransmission of information, translating to another language, as well as performing one or more activities related to copyright and requiring permission from the copyright holder.
 
2. LICENSE
 
Through the use of information provided under this license, you accept the terms and conditions set out therein.
According to the Ordinance on standard conditions for reuse of public sector information and its publication in an open format (Decree № 147/2016 of the Council of Ministers), which transposes Directive 2003/98 with rights of free reuse, processing and dissemination, each information created or collected within the powers or functions of the public sector organization shall be provided. For such information, there shall not be ground for refusal for reuse under the Access to Public Information Act, including databases, in compliance with the Law for Protection of the Personal Data. In case of restriction to reuse such information, the public sector organization shall provide only that part of the information to which access is not restricted. The Access to Public Information Act provides such a restriction in Art. 41b (1):
„Shall not be provided for reuse the public sector information containing statistical secret, collected and kept by the National Statistical Institute or a statistical authority; containing production or trade secret or professional secret; containing personal data the reuse of which amounts to an inadmissible access and inadmissible processing.“
 
2.1. This license shall grant you the right to:
2.1.1. Reproduce, disseminate and use the statistical information you have been provided by one of the means listed in Section 1, item 1.1., including for commercial purposes, without requiring the consent of a third party, but provided that you indicate the name, pseudonym or other identifying mark of the author with each use. You may not disseminate derivative or collective works.;
2.1.2. Reproduce, disseminate and use aggregated data from surveys conducted by the NSI and included in the NSP that you have been provided by one of the means listed in Section 1, item 1.1., including for commercial purposes, without requiring the consent of a third party, but provided that you indicate the name, pseudonym or other identifying mark of the author with each use. You may not disseminate derivative or collective works.;
2.1.3. Reproduce, disseminate and use text files (methodologies and survey analyses) you have been provided by one of the means listed in Section 1, item 1.1., including for commercial purposes, without requiring the consent of a third party, but provided that you indicate the name, pseudonym or other identifying mark of the author with each use. You may not disseminate derivative or collective works.
 
2.2. This license shall not grant you the right to:
2.2.2. Reproduce, disseminate and use information contained personal data in compliance with the Law for Protection of the Personal Data;
2.2.3. Reproduce, disseminate and use information, free access to which the NSI wishes to rule out by specific reasons pursuant to the Law on Statistics, the Law for Protection of the Personal Data, the Access to Public Information Act, the Law on the copyright and related rights, the Ordinance on standard conditions for reuse of public sector information and its publication in an open format (Decree № 147/2016 of the Council of Ministers);
2.2.4. Reproduce, disseminate and use information you have not been provided or not disseminated by the NSI by the means listed in Section 1, item 1.1;
2.2.5. Reproduce, disseminate and use information contained in the "Statistics" magazine. Copyright in articles published in the magazine belong to their authors;
2.2.6. Reproduce, disseminate and use information produced by other institutions and disseminated by the NSI by the means listed in item 1.1.
 
2.3. Conditions:
2.3.2. when using statistical information produced by the NSI, the user shall be obliged to indicate the source of information;
2.3.3. anyone who uses the data under the preceding paragraph shall not infringe their original meaning;
2.3.4. the National Statistical Institute shall not be responsible for the quality of information after its reproduction and dissemination by the user and for the purposes it was used by him;
2.3.5. information provided under this license cannot be used under a new license version, if it do not meet the new conditions and requirements.
 
2.4. Coverage:
2.4.1. Territorial coverage - this license, subject to its conditions, shall grant you the right to reproduce, disseminate and use the statistical information produced and disseminated by the NSI across the world;
2.4.2. Time coverage - this license shall cover the period from the date of publication to publication of a new version or another license that replaces it.
