PUNISHED CRIMINALITY AND PERSONS CONVICTED IN 2005

In 2005 the number of punished crimes is 25 766. The number of persons convicted with effective sentences is 30 501. In comparison with 2004 there is an increase of the number of punished crimes by 3.9%, and by 2.3% of the number of persons convicted.

In 2005 were accused 37 484 persons of commiting of a crime, which is 1.1% more in comparison with 2004. Effective sentences of conviction were inflicted on 19 000 persons, or 50.7% (which is 18 132 persons, or 48.9% in 2004. 11 501 persons were punished with sentence of probation, or 30.7%, their share decreasing by 0.3 points compared to the previous year. Acquittal sentence were inflicted on 1 031 of the accused persons and proceedings on 82 persons are suspended. The number of persons released from penalty is 5 870 (which is 15.7% in comparison with 17.6% in 2004).

The greater part of punished crimes - 11 908 (46.2%), were committed in 2003 and previous years. In 2004 were committed 7 252 (28.2%) of crimes and only 6 606 (25.6%) in 2005.

In 2005 the criminal activity rate of persons convicted (persons convicted per 100 000 population under criminal responsibility1) was 450 and higher (437) in comparison with 2004. Persons convicted from 18 to 24 years old are with the highest rate of criminal activity (1 320 persons convicted per 100 000 population on the same age, compared to 1 307 in 2004). The criminal activity of persons convicted from 25 to 29 years old is 906 followed by that of convicted juvenile persons from 14 to 17 years old - 825, and from 30 to 39 years old - 615, per 100 000 population of respective age.

The number of punished crimes against property (theft and robbery of property, frauds, extortion, receiving of stolen goods, destroying and damage of property) was 12 688 (49.2%) of the total number of punished crimes, by 52.8% in 2004). The number of persons convicted for this kind of crimes is, or 55.7% of the total number of persons convicted, which is 4.1 points less compared to 2004.

Thefts of property continue to be the most spread crimes. 9 477 crimes of this kind ended with sentences of conviction and in comparison with 2004 a decrease by 5.0% is apparent. The number of persons convicted decreased from 14 242 persons in 2004 to 13 348 persons in 2005, or by 6.3%. The persons from 18 to 24 years old account for 38.4% of the total number of persons convicted for thefts, followed by persons from 30 to 39 years old - 17.5%, from 14 to 17 years old - 16.9%, and from 25 to 29 years old - 16.5%.

1 199 persons were convicted for 903 robberies committed in 2005, and in comparison with 2004 there was a decrease of persons convicted and punished crimes for robbery by 4.7 and 4.4% is observed. The share of persons convicted from 18 to 24 years old, who committed robberies, is 47.6% of the total number of persons convicted for this kind of crime, followed by that of persons from 14 to 17 years old - 23.4%) and of 25 to 29 years old - 14.9%.

In Courts of Law, 756 trials for fraud and extortion ended with conviction compared to 638 in 2004. The number of persons convicted is 861 (compared to 714 in 2004).

Trials for 238 misappropriations ended with conviction sentences, which is 1.7% less compared to 2004. The number of persons convicted for these crimes decreased from 230 in 2004 to 228 in 2005, or by 0.9%.

Crimes of general character2 rank second by number and relative share in punished criminality. In 2005 the number punished crimes is 5 460. They are 21.2% from the total number of crimes with penalty inflicted (compared to 20.4% in 2004). The number of persons convicted is 5 438, or 17.8% of total number of persons convicted (compared to 16.8% in 2004).

Punished crimes and convicted persons for illegal production, possession and use of weapons, explosion and ammunition decreased respectively by 10.7% and 9.8% compared to 2004.

In relation to 2004 an increase of convicted transport and communication crimes and convicted persons for these crimes by 11.5% and 12.2% is observed.

In 2005 there were convictions on 275 cases of motor vehicles theft (compared to 340 in 2004), or 19.1% less in comparison with 2004. Persons convicted for this kind of crime are 293, and 79.9% of them are young persons from 14 to 29 years old.

In 2005 the number of punished drug-related crimes (contraband of drugs, production, acquiring, possessing, transportation, carrying and forcing to drugs addiction) increased from 698 in 2004 to 855 in 2005, or by 22.5%. There are 913 persons with inflicted conviction on them - an increase of 22.9% compared to 2004. 11 trials for contraband of drugs ended with infliction of conviction and 8 persons were convicted (compared to 15 trials and 19 persons in 2004).

The relative share of punished crimes against government and public organization activity is 10.1% of the total number of punished crimes. The absolute number of these crimes in 2005 is 2 610, and 2 950 persons were convicted for their commitment. Compared to 2004 an increase by 17.9% and 20.9% respectively is apparent.

In Courts of Law convictions inflicted in 2 232 cases of illegal crossing of the boundary, and 2 551 persons were convicted for their commitment. Compared to 2004 an increase by 21.0% and 24.7% respectively is apparent.

The number of punished crimes for bribery was 67, which is about twice more in comparison in 2004. The number of persons convicted for these crimes has increased from 32 in 2004 to 66 in 2005, or by more twice.

Punished crimes against persons (homicide, assault and battery, discrediting, kidnapping and illegal imprisonment, duress, breech of other persons' secrecy, insult and slander, debauchery and rape) were 1 858, or 7.2% of the total number of crimes with penalty inflicted.

In 2005 216 persons were convicted for 192 committed homicides (completed and attempted) - compared to 211 crimes and 202 persons in 2004.

In 2005 the number of punished crimes for rape increased by 3.2% (from 154 in 2004 to 159 in 2005). An increase by 18.9% in the number of persons convicted (from 164 persons in 2004 to 195 persons) is noticed. Most persons convicted for these kinds of crime (74.9%) are from 14 to 29 years old (compared to 62.8% in 2004).

In 2005 punished crimes against the economy were 931, and the number of persons convicted 1 006 (compared to 731 crimes and 786 persons in 2004). Punished crimes, committed in different branches of economy had the biggest share (44.5%), followed by crimes against creditors (28.1%) and crimes against monetary and credit system (12.4%).

In 2005 the number of imprisoned persons was18 435, or 60.4% of the total number of persons convicted. 17 453 persons punished were with imprisonment up to 3 years, or 57.2% of the total number of imprisoned persons, 576 persons (1.9%) from 3 up to 5 years, 291 persons (1.0%) from 5 up to 10 years, and 115 persons (0.4%) from 10 up to 30 years.

Punishments such as community service order, public censure, compulsory settlement, correctional boarding schools were inflicted on 9 076 persons, or 29.8% of the total number of persons. The punishment probation was inflicted on 2 973 persons, or 9.7%.

In 2005, at the moment of committing a crime 18 737 persons, or 61.4% of the total number of convicted persons are unemployed. Convicted unemployed young persons from 18 to 24 years old were 7 194, or 38.4% of all convicted unemployed persons (compared to 39.8% in 2004).


CONVICTED JUVENILE PERSONS IN 2005

In 2005 3 273 juvenile persons (from 14 to 17 years old) were convicted, comprising 10.7% of the total number of persons convicted. The decrease in number of convicted juvenile persons is by 4.0% compared to 2004, when the number was 3 408.

A sentence on probation was inflicted on 1 439 persons, or 44.0% of the total number of convicted juvenile persons. 1 545 juvenile persons were sentenced to imprisonment (compared to 1 761 in 2004) and 1 240 to public censure. The punishment on probation was inflicted on 137 juvenile persons, or 4.2%.

Convicted juvenile persons on age 17 accounted for the highest rate of criminal activity (1 188 on 100 000 persons of the respective population), followed by the criminal activity of convicted persons aged 16 (907). As regards persons 15 years old, this rate is 686 persons, and with 14 years old is 476 per 100 000 persons of respective population.

2 660 juvenile persons were convicted for crimes against property, and in the case of theft of property crimes the number is 2 251 (compared to 2 402 persons in 2004, or 6.3% less). The share of persons, convicted for theft is 68.8% of the total number of convicted juvenile persons, which is 1.7 points less in comparison with 2004. 281 persons from 14 to 17 years old were convicted of robbery of property, or by 17.8% less than the previous year.

As regards crimes against persons an increase in the number of convicted juvenile persons (from 141 in 2004 to 192 in 2005, or by 36.2%) is observed. In 2005 7 juvenile persons were convicted of intentional homicide (compared to 11 persons in 2004, or by 36.4% less). 90 juvenile persons were convicted for debauchery, of which 32 persons for rape (compared to 20 persons in 2004, or by 60.0% more).

76 juvenile persons were convicted of theft of motor vehicle, or 5.6% more in comparison with 2004. An increase in the number of convicted persons from 14 to 17 years old for drug-related crimes - from 96 persons in 2004 to 102 in 2005, or by 6.3% is apparent.

1 "Persons under criminal responsibility" are those, who are of age and may commit a crime in a state of responsibility, as well as juvenile persons, who are 14 years old, but not 18 years old yet, and could comprehend the nature and meaning of their deeds and control their acts (Criminal Code, Article 31, para 1 and 2).
2 Crimes, committed by general way or by using means of general character, transport and communication crimes, crimes against public health, crimes in using atomic energy for peaceful purposes and other crimes.
